But still, if your playing the other warcraft games and your sending a squad of units to the enemy base, and you happen to pass, say 1 scouting unit, why wouldn't there be a penalty for killing it when you have a squad of like 20 units. I was just expecting WoW to be like Warcraft, with some MMORPG elements

In the main forums a dev already said they are aware of these issues and they are not finished with everything.

WoW isn't like Warcraft, it is an MMORPG which means the rules are different.

The only connection between Warcraft games and WoW is names, races, areas, spells, etc.. Warcraft games were RTS well WoW is a MMORPG.

Two different genres which require two different set of rules to operate.

I played on the constant PvP server on Asheron's Call 2 awhile ago and the gankers-to-real players ratio balanced out in the long run for the most part. It got to the point where there were one or two guilds that went RPK (Random Player Killing) but they hardly ever got the chance due to the fact that real guilds dipped into the newbie pool and protected them. It also got to the point where the RPK guilds went kill-on-sight to almost everyone in the server.

So I think in this scenario Blizzard might be overpreparing for the problem.

EQ PvP was the best even though it was terribly imbalanced and with all the trainers.
I loved killing the trainers and the KOS guilds.
