Honestly, shiv scales like crap. You should never really be using it in an instance except for the explicit reason of applying poison: IE the first poison for mute if you don't get a proc, or crip on a runner in a 5 man maybe. It shouldn't be a source of energy or CP in most cases. That being said, with a fast sword and DW spec, it's not that bad if used to finish off a mob or something with instant poison. With my combat dagger build I find myself using it to farm quite often. It takes things down fast after the initial CS>backstab, has extra damage via instant poison (like the + damage from SS), and frankly a dagger doesn't hit that hard with SS anyway :P. The attack is normalized, so even though I'm using a 1.4 sec sword in my OH, I'm getting the 2.4 sec AP multiplier. With almost 1500 unbuffed AP... it's not all that bad... on yeah and the extra CP procs since I'm attacking with my OH.
The problem with the attack itself in raids/instances is that it's only doing a max of 75% weapon damage with 5/5 dw spec. As soon as you start getting buffs or using trinkets and such, it shows it's weakness. It doesn't scale well - and the poison part is static, so it doesn't scale at all. Since your combat swords, I would recomend only using it for snares with crip. There is really no reason for you to be using it over SS with your MH weapon for a 5 energy difference.
