Doesn't need to. It's not illegal to have smoked pot, just illegal to operate a motor vehicle on the influence. Besides, it's easier to get a OWI tossed then it is DUI just because you're more likely to have paraphernalia on you at the time of the stop. Being legal or not, I'm fairly convinced that it would hold up in court pretty well.

Think akin to having an open beer in your lap when you get pulled over. That roach in the ashtray will seal the deal when the cop uses his nose to smell the marijuana. Just like booze. Reasonable suspicion and all that.
