The 4th and the other half of the 9-tails are sealed within the Death God so there is no way they can be Tobi without trampling the established rules of said jutsu. Yeah, Kishi can do whatever he wants within the playground of his manga but it would make absolutely no sense.
Tobi being some element of Madara however is possible and wouldn't destroy the rules set down in the manga so far. The horcrux theory (Tobi is actually a piece of Madara that has gone rogue/seeks to be Madara) certainly holds some water as does the theory that Tobi is a Zetsu-style Madara (created by Madara to continue his plans until his predicted revival via the rinnegan jutsu) which would explain his wildly different personalities, the need to mask his appearance, the replacement arm and his close planning with Zetsu.
Uh you guys realize Orochimaru is permanently sealed right?
Itachi's Susanoo drained Oro from Sasuke's body and sealed him within a permanent genjutsu. There's no way hes coming back on the same level that we're never seeing the 3rd, 4th or the other half of the 9tails again.
Kabuto is our Orochimaru replacement.

Also, Orochimaru isn't one for hiding behind a mask for this long I suppose.
The problem is rules are only good up to the last chapter. There is absolutely no reason to believe that a once established rule won't be bent or even broken to further a storyline. Especially when the writer starts running out of things he can do with his/her own established rules and has to start pushing those self containing boundaries to continue a series that has no ending in sight. It usually isn't a problem for short(er) series, but this isn't anything resembling short. It's the essence of bad writing, and it is what currently plagues Bleach.
Anyway, those were just bad writing scenarios I thought up while reading Captain America.

Reverse trolling, even. Fairy Tail is using it as an excuse to depower the main cast, whereas everyone else uses it to power them up. I find that interesting in itself.
Also, Gai joins the fight. Always liked his (and Rock Lee's) fighting style, though it unfortunately also has the distinction of being the worst animated fight scene in anime history.

So, is anyone keeping up with the anime? It has finally ended the filler again. I really enjoyed the first episodes of this season, particuarly the last few (6-9 of this season, something like that). I always thought Minato was a little calm for Naruto's dad (I would spoiler that, but... it is pretty obvious). His mum Kushina(sp?) was much more what I expected, I really enjoyed her screen time. I don't follow the manga as I tend to drift in and out of anime/manga phases, but I doubt we will see a lot more of her?
Here's hoping the anime will pick up the pace again, Shippuden had such promise (Hidan and Kakuzu arc being one of my all time favourites) but filler really killed it sometimes.

Yeah, they haven't appeared again in the manga, nor do I expect them to. The whole parents thing has essentially been resolved, and with (manga spoilers)Naruto making peace with the Kyuubi and them working together, it's really not likely.

You should really read the manga. A lot of the content, none of the filler. The only drawback is that the "big" fights (Naruto vs Sasuke, Pain vs Naruto, etc.) tend to get more detail in the anime and be longer/more epic.
BG(Souj) has the best theory for who tobi is. Sasuke Sarutobi. The thirds father. I'll copypasta some of it.
Sautobi Sasuke is of course based on the ninja from japanese folklore of the same name. That Sarutobi sasuke formed a group of 10 legendary ninja. Hmmmm a group of 10 legendary powerful ninja... where could I have heard of that before? Hmmmmmm 4th Hokage questioned who could know how to break the nine-tails seal and how he knew how to secretly infiltrate all of Konoha's defenses unnoticed. That is definitely information the father of a previous Hokage could not possibly ever get his hands on!
Hmmmmmmmmmmmmmm Sasuke Sarutobi was considered a great ninja with a reputable name, yet Kabuto, who has Edo'd lesser ninja with lesser renown, did not Edo Tensai Sasuke Sarutobi. Hmmmmmmmmmmmmmmmmmm

holy ****... that actually makes a fair amount of sense... The only real problem, where he got his sharingan in the first place, is solved by the fact that he's prone to taking and replacing peoples' eyes... Though, he would also be a lot older than his unmasked appearances and non-gray hair would lead people to believe, so I think there'd probably still be some hijinkery going on there. Still, this is probably the best and most logical theory I've heard, so there's no way in **** kishimoto will use it.

The animated fight scenes are the only real reason I enjoy the anime. Though, to be fair, a lot of the filler in shippuuden was done fairly well by using it to expand on **** like the capture of the three and six-tails. This latest filler arc was utter, blatant **** though.
